Right to be Forgotten

Last updated: 1 October 2026

Level Trust respects your right to control how your personal information is used.

Under UK data protection law, you may have the right to ask us to delete personal information that we hold about you. This is known as the right to erasure, and is sometimes referred to as the right to be forgotten.

Level Trust is a registered charity in England and Wales, charity number 1178223.

Your Right to Request Deletion

You can ask Level Trust to delete personal information that we hold about you in certain circumstances.

This right may apply where:

  • the personal information is no longer necessary for the purpose for which it was originally collected or processed

  • you previously gave your consent for us to use the information and have now withdrawn that consent

  • you object to us processing your information and there is no overriding lawful reason for us to continue

  • your personal information has been processed unlawfully

  • the information must be deleted to comply with a legal obligation

  • the information has been used for direct marketing and you object to this use

The right to erasure is not an absolute right and there may be circumstances where we are legally required or permitted to retain your information.

When We May Need to Keep Your Information

We may be unable to delete some or all of your personal information where retaining it is necessary:

  • to comply with a legal or regulatory obligation

  • to maintain financial, accounting or charity records

  • to comply with HM Revenue & Customs requirements, including records relating to Gift Aid

  • for safeguarding purposes

  • to protect the welfare or safety of a child, young person or another individual

  • for the establishment, exercise or defence of legal claims

  • to meet contractual obligations

  • for certain archiving, research or statistical purposes where permitted by law

  • for another lawful reason which requires us to retain the information

Where we need to retain only part of your information, we will consider whether the remaining information can be deleted.

Children and Young People’s Information

Level Trust works with children, young people and families, and we recognise that their personal information requires particular protection.

Requests relating to information collected when an individual was a child will be given particular consideration.

However, there may be circumstances where safeguarding, legal or regulatory requirements mean that certain records must continue to be retained.

How to Make a Request

You can ask us to delete your personal information verbally or in writing.

You do not have to use the words “right to be forgotten” or “right to erasure” for us to consider your request.

To help us locate the correct information, please provide:

  • your full name

  • your contact details

  • details of the information you would like us to delete

  • any other information that may help us identify the relevant records

You can make a request through the Contact Us page on our website or by contacting:

Confirming Your Identity

We may need to ask you for reasonable information to confirm your identity before carrying out a deletion request.

This helps us ensure that personal information is not disclosed or deleted at the request of somebody who is not authorised to act on your behalf.

We will only request information that is necessary and proportionate for this purpose.

How Long Will We Take to Respond?

We will respond to a valid request without undue delay and normally within one calendar month.

For particularly complex requests, or where you have made a number of requests, we may be permitted to extend this period by up to a further two months.

If we require additional time, we will let you know and explain why.

Information Shared With Other Organisations

Where we have shared your personal information with another organisation and we are required to erase that information, we will take appropriate steps to inform relevant recipients of the deletion request where required by law.

Other organisations may have their own legal obligations that require them to retain certain information.

Information Held in Backups

Personal information may remain temporarily within secure backup systems after it has been removed from our active systems.

Where information cannot immediately be deleted from a backup for technical reasons, it will remain protected and will not normally be used for any other purpose until the backup is overwritten or the information is permanently deleted.

If We Cannot Delete Your Information

If we are unable to comply fully or partly with your request, we will explain why, unless the law prevents us from doing so.

Depending on the circumstances, you may have the right to ask us to restrict the way your information is used instead.

Raising a Concern

If you are unhappy with how we have handled your personal information or your request for deletion, please contact Level Trust so that we can investigate your concern.

You also have the right to raise a concern with the Information Commissioner’s Office (ICO), the UK’s independent regulator for data protection.

Further information is available at ico.org.uk.

We may update this policy from time to time to reflect changes to our activities, legal obligations or data protection requirements.
